Terms of Service

These Terms of Service (“Terms”) govern your access to and use of agileviz.com and the AgileViz service (the “Service”). The Service is operated by AgileViz, a sole proprietorship owned and operated by Richard Mouser, located in Dime Box, Texas, United States (“we,” “us,” or “AgileViz”).

By creating an account, starting a trial, or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

2. Account & License

  • Each subscription is tied to a single email address.
  • Upon payment, we grant you a non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during the subscription period.
  • You may generate and share reports or screenshots created with the Service, but you may not share your login credentials or otherwise allow third parties to access the Service under your account.

3. Free Trial

New users receive a 14-day free trial. No payment method is required until the trial ends. The trial automatically converts to a paid monthly subscription unless you cancel beforehand.

4. Pricing & Payment

  • Pricing is as shown on the pricing page at the time of purchase.
  • Monthly plans are billed every 30 days; annual plans are billed every 12 months.
  • All subscriptions automatically renew until cancelled.
  • We will send a reminder email before each renewal charge.
  • Payments are processed by Stripe. You authorize us to charge the payment method on file.

5. Cancellations & Refunds

  • You may cancel at any time with no further charges.
  • Monthly plans: no refunds or prorations.
  • Annual plans: if cancelled mid-term, we will issue a prorated refund for the unused whole months remaining.
  • No refunds for partial use or dissatisfaction.

6. Late or Failed Payments

If a payment fails, you have a 7-day grace period to update your payment method. After 7 days, access will be suspended until payment is brought current.

7. Prohibited Conduct

You agree not to:

  • Share your account credentials
  • Use bots, scripts, or excessive automated queries that could impair Azure DevOps or the Service
  • Reverse engineer, decompile, scrape, or attempt to derive the source code of the Service
  • Use the Service to violate any law or third-party rights
  • Resell or sublicense access to the Service

8. Your Azure DevOps Credentials

You connect the Service to your own Azure DevOps organization using your own credentials. You are solely responsible for any activity that occurs through that connection and for keeping your credentials secure.

9. Termination

We may suspend or terminate your access immediately, without notice, for non-payment or violation of these Terms. Upon termination, your right to use the Service ends immediately.

10. Data After Termination

All account data and session information is permanently deleted within 30 days of termination or trial expiration.

11. Support

Support is provided on a best-effort basis via the contact form during normal U.S. Central Time business hours.

12. Availability

The Service is provided “as-is” and “as-available.” We strive for high availability but do not guarantee any specific uptime.

13. Limitation of Liability

To the fullest extent permitted by law, our total liability to you is limited to the amount you paid us in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.

14. No Warranty

The Service is provided “AS IS” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted operation.

15. Changes to Terms

We may update these Terms at any time. We will notify active subscribers by email and highlight material changes. Continued use after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
